HACK4CLIMATE: TERMS AND CONDITIONS

These Terms and conditions (‘Terms’) apply to the participation of an individual in the Hack4Climate Hackathon to be held from Sunday 12 November 2017 to Thursday 16 November 2017 at UN Campus, Bonn, Germany.

By registering for Hack4Climate, You agree that You understand these Terms and agree to be bound by these Terms.

Hack4Climate is organized and conducted by the Cleantech21 Foundation (‘Cleantech21’) with support from Rockstar Recruiting AG, Impact Hub GmbH and Validity Labs.

You agree that if you do not comply with all of these Terms and Conditions, you may be disqualified from involvement in the Hackathon and/or from having Your Entry considered.

The Organizers reserve the right to change the Terms at any time without prior notice.

The Organizers reserve the right to cancel, modify or suspend Hack4Climate at its sole discretion.

If Hack4Climate is cancelled, Cleantech21 may, but is not obliged to, select a winning Entry from those submitted before the Hackathon is cancelled.

DEFINITIONS

Cleantech21: Cleantech21 Foundation, Reitergasse 11, 8004 Zürich, Switzerland;

Rockstar: Rockstar Recruiting AG, Seilergraben 53, 8001, Zürich, Switzerland;

Impact Hub: Impact Hub GmbH, Lindengasse 56 / 18-19, 1070, Vienna, Austria;

Validity Labs: Validity Labs AG, Bösch 80A, 6331, Hünenberg, Switzerland;

Hack4Climate: The Hack4Climate Hackathon held from 12.11.2017 – 16.11.2017 in Bonn, Germany and organized by Cleantech21 for the Climate Ledger Initiative;

 

Organizer: Any individual and/or company authorized by Cleantech21 or its duly authorized agent to be involved in organizing Hack4Climate, including but not limited to: Cleantech21, Rockstar, Impact Hub, and Validity Labs;

You (and Your and Yours): means the person who is registering to participate in the Event

Applicant: An individual who applied to participate in Hack4Climate to take part in at least one Hack4Climate challenge;

Participant: An individual who has been selected to take part in at least one Hack4Climate challenge;

Selection Team: The team of individuals, as decided by the Organizers, responsible for screening and selecting Applicants to participate in Hack4Climate;

Application: An application made by an individual in order to participate at Hack4Climate as a Participant;

Challenge: One of the six Hack4Climate challenge categories in which Participants compete at Hack4Climate;

All defined terms should be interpreted to make reference to the single and plural use of the term as well as the female and male form wherever reasonable.

ELIGIBILITY

You can apply for the Hackathon if You are: 18 years or older; and you are eligible to travel to Bonn, Germany, for the dates of Hack4Climate subject to the usual visa restrictions of your country; and All Participants will be required to present an acceptable form of ID with a photo at the Hackathon. Applications, Screening and Selection. In order to be registered as an Applicant, You must: fully complete and submit the Application Form before 1. November 2017; and comply with the Eligibility Criteria set out in in this Document;

You are responsible for ensuring that you are able to connect to and lodge your Application Form before the deadline, and for all costs you incur in relation to the registration. The Organizers accept no responsibility: • for registrations that are late, not received, incomplete or contain incorrect or inaccurate details; or • if the Hack4Climate website is not available to any applicant or participant for any reason.

The Organizers may, at their own discretion, allow late registrations. These Terms and conditions (‘Terms’) apply to the participation of an individual in the Hack4Climate Hackathon to be held from Sunday 12 November 2017 to Thursday 16 November 2017 at UN Campus, Bonn, Germany.

PARTICIPATION

Participation at Hack4Climate is not guaranteed to every applicant.

Rockstar will screen applications and select Applicants to invite to participate in Hack4Climate. The number of Participants at Hack4Climate is limited to 100. The selection of Participants is at the absolute discretion of the Selection Team. The Selection Team will select Participants in good faith. If, after a Participant has been selected and notified of their successful application as a Participant and information comes to the Organizers’ attention which may make that Participant unsuitable to attend Hack4Climate, it is at the Selection Team’s absolute discretion to retract their invitation for Participation and/or disqualify the Participant.

All Applicants who have been selected to participate in Hack4Climate will be notified of their successful application.

SCREENING

All Applicants who have been selected to participate in Hack4Climate will be notified of Applications to Hack4Climate will be screened by Rockstar and the Selection Team. By registering as an Applicant to Hack4Climate, you consent that any information provided by you may be read, collected and stored by Rockstar. Rockstar will store your data in the Rockstar database. By registering as an Applicant, you agree that any information provided by you in the application process may be stored by Rockstar until at least the completion of Hack4Climate. If You wish for your information to be deleted prior to completion of Hack4Climate, it is the sole discretion of the Selection Team to retract their invitation to participate. If you do not wish for your information to be stored beyond Hack4Climate, you may withdraw your consent at any time by either (1) indicating it on the Application Form or (2) contacting Rockstar directly.

It is at the sole discretion of the Selection Team to define and apply the selection criteria used in selecting potential Participants.

CHALLENGES

There will be six Challenges at Hack4Climate.

Participants may participate in one and only one Challenge. Exceptions are at the sole discretion of the Organizers.

PROTECTION OF INTELLECTUAL PROPERTY

All submissions to Hack4Climate remain the intellectual property of the individuals or organizations that developed them. By registering, consenting to the terms of the Hackathon, and entering a Submission, however, the Participant agrees that the organizers, sponsors and technology partners reserve an irrevocable, non-exclusive, royalty-free license to use, distribute to the public, and publicly display and perform the Submission on an educational, promotional and not-for-profit basis starting on the date of the commencement of Hack4Climate as an example of work. Climate data streams shared during the Climate Action Hackathon remain the property of the data stream creators and are granted non-exclusive license for the period of the Hackathon and subsequent business development phase. We encourage participants to open source their projects to both share their work with the greater community and promote innovation in this space.

PRIZES AND JUDGING CRITERIA

The Organizers will, at their absolute discretion, appoint a jury for Hack4Climate. Entries will be judged based on the following criteria: Functionality, Innovation, Benefit to Society, Environmental Impact
You agree that the decision of the judges is final and that appeals will not be considered.

There are two types of prizes: prizes per category (‘Category Prize’) and a single prize for an audience-voted winner (‘Audience Prize’).

Every Challenge category will have one Category Prize in the amount of EUR 10’000 to be awarded to the category winner.

The Audience Prize is EUR 25’000 to be awarded once.

TRAVEL, FOOD AND LODGING COSTS

It is the Participant’s responsibility to organize their travel arrangements to Hack4Climate. Cleantech21 will reimburse Participants for their travelling expenses to and from Hack4Climate, subject to the following limitations:

  • the Participant completed least one of the Hack4Climate Challenges
  • the Participant provided a valid receipt of their travel expenses to and from Hack4Climate
  • the travel expenses do not exceed the value of CHF 2’000
  • the travel arrangements are kept as low as reasonably possible (for instance: Economy class airfare ticket instead of Business or First)

Cleantech21 will provide accommodation and food for Participants during Hack4Climate. Cleantech21 will endeavor to accommodate special travel, food or lodging requirements for Participants in so far as is practicable.

It is the responsibility of the Participant to inform Cleantech21 and/or Rockstar of any special travel, food or lodging requirements that the Participant has for attending Hack4Climate at least 30 days prior to Hack4Climate. How and to what degree Participants’ special travel, food or lodging requirements are met is at the absolute discretion of Cleantech21.

If a Participant can no longer attend Hack4Climate, it is the Participant’s responsibility to notify Rockstar as soon as reasonably practicable.

SAFETY

You acknowledge that your participation in the Hackathon may be intensive. You agree to behave in a professional, respectful, non-disruptive and appropriate manner, including taking all reasonable care and responsibility for your own health and safety and that of others at all times while participating in the Event, including when travelling to and from the Event.

You agree that you will not consume alcohol if you are under the age of 18 years old during the Hackathon.

You agree that you are responsible for your wellbeing, including ensuring that you get sufficient rest and nutrition during the Hackathon. However, if you have concerns about your health, safety or welfare at any time during the Hackathon, you may withdraw from the Hackathon at any time. Please notify the Organisers if you decide to withdraw from the Event.

You agree to comply with all relevant laws and any safety or operational policies or reasonable directions that Council, the Hackathon organisers or any third party providers may give You. This includes where access to any facilities or use of any equipment is made available to you in connection with the Hackathon.

CONDUCT

To the maximum extent permitted by law, Organizers reserves the right to change these Terms & Conditions at any time. You further agree to be bound by the decisions of Organizers and the judges which shall be final and binding in all respects. The Organizers reserve the right, at its sole discretion, to disqualify any individual that tampers or attempts to tamper with the Hack4Climate process or the operation of the Contest or website; violates the official contest rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

LIABILITY

To the maximum extent permitted by law, Organizers reserves the right to change these Terms & Conditions at any time. You further agree to be bound by the decisions of Organizers and the judges which shall be final and binding in all respects. The Organizers reserve the right, at its sole discretion, to disqualify any individual that tampers or attempts to tamper with the Hack4Climate process or the operation of the Contest or website; violates the official contest rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

By agreeing to these Terms, you represent and warrant that:

  • Your Entry is based on the original ideas of You and or Your team and you have not copied Your entry from any third party;
  • You have not, and no member of Your team has, submitted your Entry, or the idea on which your Entry is based, to any other Hackathon, competition, assessment process, tender process or to any third party; and
  • You agree that You shall be liable for, and shall indemnify and hold harmless the Organizers, and any officers, employees, contractors and agents of the Organizers, against any and all actions, third party injuries, losses, claims, demands or damages of any kind arising from or in connection with Hack4Climate, including, without limitation, claims for loss or damage in relation to intellectual property, any type of defamation, right of privacy, personal injury, individually or collectively, resulting from the fault, negligence, or wrongful act or omission of the Participant.

You agree that the Organizers will disclaim all warranties, to the extent permissible by law, including warranties that:

  • the Hackathon will run uninterrupted or without error;
  • the information provided as part of the Project Brief or Hackathon is accurate.

You further agree to be bound by the decisions of Organizers and the judges which shall be final and binding in all respects. The Organizers reserve the right, at its sole discretion, to disqualify any individual that tampers or attempts to tamper with the Hack4Climate process or the operation of the Contest or website; violates the official contest rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

The Organizers are not responsible for: (1) any false, incorrect or inaccurate information, whether caused by Participants, printing errors or by any of the equipment or programming associated with or utilized in Hack4Climate; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or Hack4Climate; (4) technical or human error which may occur in the administration of Hack4Climate or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Particpant’s participation in the Hack4Climate or receipt or use or misuse of any prize. If for any reason an entrant’s Submission is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is to provide another Submission.

MARKETING AND PUBLICITY

Except where prohibited, participation in the Climate Action Hackathon constitutes participants consent to the Organizer’s use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without payment or consideration.

You agree that the Organizers may use the title of Your Entry, Your name, photographs and details of your expertise on the Hack4Climate website and in promotional or marketing material.

You agree that, if You win a prize, You will provide to the Organizers a written statement which describes generally the nature of the winning Entry. The Organizers may make this statement, or an edited version, publicly available.

You agree that you will direct any media enquiries or enquiries from anyone looking to publish information about Hack4Climate to the Organizers.

You must not use any of the Organizers’ trademarks or logos on any documents, presentations or other materials relating to Hack4Climate unless and until you have obtained the Organizers’ written consent, as well as the individual consent of the Organizer who’s material You intend on using.

You understand that you may be requested to undertake media interviews in relation to Hack4Climate.

JUDICIAL PROCEDURES

No Recourse to Judicial Procedures

In the event that an Applicant or Participant should disagree with any of these Hack4Climate Rules or any decision made by the Organizers or the Judging Panels, the Applicant Participant will have the right to withdraw their Submission. To the extent permitted by law, the rights to litigate, to seek injunctive relief or to any other recourse to judicial procedure in case of disputes or claims resulting from or in connection with this Climate Action Hackathon are hereby excluded, and Applicants and Participants and Volunteers expressly waive any and all such rights.
